Contract Termination and Return of Purchased Product
Contract Termination
The Buyer may terminate the Contract (cancel the order):
- Unilaterally, without giving reasons for the termination of the contract within 90 days from the date of product delivery
- In the case that the delivered product is defective
Unilateral Termination of the Contract
In accordance with the Consumer Protection Act, in the case of distance purchases (when it is not personal pickup but sent by delivery service), you are authorized to unilaterally terminate the Contract without giving reasons for it within 90 days from the date of product delivery, or the delivery of the last product from the order. You can unilaterally terminate the contract using the mentioned form or through any other unambiguous statement expressing your will to terminate the contract and providing the necessary order information as stated in the One-Time Termination of the Sales Contract Form.
To exercise the right to unilaterally terminate this Contract, you must inform Nude&Rude at info@nudeandrude.eu of your decision to unilaterally terminate the contract before the expiration of the 90-day period, by an unambiguous statement sent by mail or electronic mail, stating your name and surname, address, phone number or email address, and you can also use the attached example form for unilateral termination of the contract.
In the event of unilateral termination of the contract, we will act in accordance with the Consumer Protection Act and the Obligations Act. We will refund the paid amount for the goods for which you are requesting a unilateral termination of the contract, without delay, and no later than 14 days, from the day when the goods are received at the seller's address or after receiving confirmation proving that you have returned the goods to the warehouse and that the warehouse has received them. The refund will be made in the same way you made the payment. Please note that the refund process for cards may take a few days longer to see the amount on your card.
The buyer must return the goods without delay, and no later than 14 days from the day when the unilateral termination of the contract was reported. In accordance with Article 77, paragraph 5 of the Consumer Protection Act, the buyer is responsible for any reduction in the value of the purchased product resulting from handling the purchased product.
A prerequisite for unilateral termination of the Contract is that the product has not been used and is returned to the Seller in the identical condition in which it was received by the Buyer, in the original packaging, with the declaration and accompanying documentation. The buyer has the right to a free return of goods to the Seller if all the Seller's conditions are met, that the product/products that were ordered and delivered, and that the same were delivered to the Buyer undamaged.

Termination of Contract Due to Product Defect
In the event that the reason for return or exchange is a damaged or defective product, the exchange is at the expense of the Seller, provided that the Product was received without visible external damage during transport. It is necessary to report product defects within 5 working days of receipt.
If the goods are damaged upon receipt from the delivery service and the Buyer notices a reason for complaint due to handling during delivery, the goods should be immediately reported to the delivery person because complaints related to transport and delivery reported after the delivery of the delivered Products will not be considered by the Seller.
Responsibility for Material Defects of Products
The seller is responsible for material defects of the items it sells on its website in accordance with positive regulations, especially the Obligations Act of the Republic of Croatia and the Consumer Protection Act.
Execution of Product Returns
Ordered products are packed in such a way that they do not get damaged during usual handling in transport/delivery. Packages may include various protective materials to prevent breakage (paper, styrofoam, sponge, and/or similar).
The buyer is obliged to return the product to the Seller complete, in all cases when returning the Product for any reason, and in the condition in which it was delivered to him and in the original packaging (commercial packaging in which the goods were also delivered), with all accompanying parts and documentation, and any label indicating that the Product has not been used or damaged must not be removed or damaged. The product must not be used more than 20%, i.e., at least 80% of the product must be preserved in order to meet the conditions for return.
If the Buyer returns the product defective, with major damage, or without parts and documentation, and if it is not delivered within 14 days from the report of contract termination, it is considered that the Buyer has not fulfilled his obligation to return the goods, and the Seller is not obliged to refund the paid funds or exchange.
The buyer must return the goods without delay and no later than 14 days from the day when, in accordance with Article 74 of the Consumer Protection Act, he notified the Seller of his decision to terminate the contract. It is considered that the Buyer has fulfilled his obligation on time if he sends the goods or delivers them to the Seller before the expiration of the aforementioned period. The Buyer is responsible for any reduction in the value of the goods that is the result of handling the goods, except for what was necessary to determine the nature, characteristics, and functionality of the goods.

Justification of Returns
If the return request is justified, the Seller will, based on the return or exchange request, refund the funds to the account specified by the Buyer in the request or exchange the product for a new one within a maximum of 15 days from the date of receipt of the returned product at the address specified in the complaint form. If the Seller undoubtedly determines that the product complaint is unjustified or that the defect of the ordered product occurred due to inadequate handling or use, the Seller is not obliged to refund the money or deliver a replacement product with a written explanation of the reasons for not accepting the return or exchange request.
Order Protection
By purchasing from us, the buyer can take advantage of package protection for €1.00. In case of loss or damage to the package, protection will ensure that a new package is sent to you as soon as possible. If the package has already been paid for and the products are no longer available, we will refund the money. With this additional option, we send a new product or return the money without many questions.
Complaints and Grievances
The seller guarantees the quality of the products guaranteed by the manufacturer of the Basic Model brand. The online store www.nudeandrude.eu and the Seller allow you to send your written complaints related to online shopping to the email: info@nudeandrude.com. We will respond to all your complaints and grievances within a maximum of 5 days.
To confirm the receipt of the written complaint and then respond to it in accordance with Article 10, paragraph 5 of the Consumer Protection Act, you need to provide accurate information for the delivery of the response to the complaint in the written complaint.
Online Dispute Resolution
A special regulation of the European Union from February 15, 2016, allows disputes related to online purchases to be resolved via the ODR platform throughout the EU. If you encounter a problem during online shopping within the EU (defective product, inability to exchange products, etc.), you can submit your complaint in a faster and simpler way at the ODR platform link. The advantage of this platform is that it can be used by both consumers and traders, and the complaint can be submitted in any of the 23 official EU languages.
